Terms of Service

1. The Service

Akacia is a private portal through which Turn Up Technologies monitors, reports on and manages the Google Ads accounts of its agency clients. It provides live performance dashboards, automated account findings, campaign-management tools and an AI assistant scoped to each client account. The Service is provided to clients of Turn Up Technologies under their service engagement with us; it is not a self-serve public product.

2. Accounts and access

• Portal accounts are provisioned by Turn Up Technologies at a client's request. You are responsible for keeping your credentials confidential and for all activity under your account.
• Access is role-based: client users can view and interact with their own client account only. You must not attempt to access data or areas of the Service you have not been authorized to use.
• Notify us promptly at the contact address below if you suspect unauthorized use of your account.

3. Google Ads authorization

The Service reads and manages Google Ads accounts through the official Google Ads API, under OAuth authorization granted by the account owner. By linking an account you confirm you are entitled to grant that access. Authorization can be revoked at any time from your Google account settings, after which the Service can no longer access the account. Our handling of data received from Google APIs is described in our Privacy Policy and adheres to the Google API Services User Data Policy, including the Limited Use requirements.

4. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of Google's or any advertising platform's policies;
• probe, scan, disrupt or attempt to breach the Service's security or access controls;
• share, resell or provide access to the Service to anyone not authorized by us;
• copy, scrape or reverse-engineer the Service or use it to build a competing product;
• misuse the AI assistant, including attempts to extract data belonging to another account.

5. Data and privacy

Our collection and use of data — including Google Ads data accessed on behalf of clients — is described in the Privacy Policy, which forms part of these terms. In short: your data is used to operate the Service for you, is never sold, and is accessible only to authorized personnel and the users you have asked us to provision.

6. Service content and advice

Dashboards, findings, estimates and assistant responses are produced from live account data and automated analysis. They are provided for information and account management, not as financial, legal or medical advice. Advertising performance depends on factors outside our control, and figures shown may occasionally lag or differ from Google's own reporting. Where the Service estimates time to complete a fix, this is a good-faith estimate, not a guarantee.

7. Intellectual property

The Service, its design, code and content (excluding your account data) are owned by Turn Up Technologies. Your account data remains yours; you grant us the rights needed to process it to provide the Service. "Google Ads" is a trademark of Google LLC; Akacia is an independent product and is not endorsed by or affiliated with Google.

8. Suspension and termination

We may suspend or terminate access that breaches these terms or threatens the security of the Service. Clients may end their engagement as set out in their service agreement with us; on termination we delete associated account data as described in the Privacy Policy. Sections 6, 7, 9 and 10 survive termination.

9. Disclaimers and liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties and are not liable for indirect, incidental or consequential damages, loss of profits, or loss of data arising from use of the Service. Our total liability for any claim relating to the Service is limited to the amounts paid to us for the Service in the three months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law.

10. Changes and governing law

We may update these terms from time to time; material changes will be notified by email or in the portal, and the effective date above will change. Continued use after changes take effect constitutes acceptance. These terms are governed by the laws applicable where Turn Up Technologies is established, and disputes will be resolved in the courts of that jurisdiction unless a client's service agreement says otherwise.
